Description: The defendant officers knocked on the plaintiff's door claiming to be investigating a noise complaint although there was no excessive noise. The plaintiff refused to let the defendant officers inside, but the officers pushed the door open and forced their way in without a warrant. Even though nothing illegal was found, the defendant officers arrested the plaintiff and took her to a local precinct followed by Central Booking. She was charged with endangering the welfare of a child pursuant to New York Penal Law ß260.10(1). The DA declined to prosecute and she was later released.

Description: Plaintiff was in his home when Officer Dennis and another Officer knocked on Mr. Cabrera's door and told him there was a warrant for his arrest on DWI charges. Mr. Cabrera had never been arrested before and tried to explain that to both Officers, when they asked Mr. Cabrera to accompany them down stairs, which he did since he knew he had not done anything wrong. When they got downstairs Mr. Cabrera was handcuffed and taken to the 30th precinct where he was issued a Desk Appearance Ticket for possession of a forged instrument. Charge was later dismissed.
