Description: Defendant Officers came to Plaintiff's apartment in response to a 911 call alleging that he had broken an individual's cell phone. Officers ordered Plaintiff to take a walk to calm him down from a heated argument and so he went to tell his daughter that he was leaving. Officers then grabbed him, pepper sprayed him, handcuffed and arrested him. Plaintiff was taken to the hospital then the 25th Precinct, where he was charged with Endangering the Welfare of a Child, Criminal Mischief, Resisting Arrest, and Harassment. Charges were dismissed 30.30
