Description: On or about July 28, 2024, Plaintiff was a pedestrian on the street leaving the Dominican Day Parade. Plaintiff was following the instructions of police officers directing the flow of pedestrian traffic. Plaintiff and Defendant NYPD officers Nevling got in a verbal dispute and when the Defendant repeatedly shoved Plaintiff backwards. Defendant Nevling and another Defendant NYPD officer Lopez brutally punched and struck Plaintiff about the head or body. Several other unknown Defendant NYPD officers joined in the assault of Plaintiff. Plaintiff was then confined and arrested without any legal cause or justification.

Description: On July 6, 2023 Plaintiff was lawfully in the vicinity of an intersection when PO Jose Rivera, PO Omar Aguilar Martinez, PO John Doe, and PO John Roe stopped him based in part due to racial prejudice and summarily grabbed, searched, assaulted, battered, and falsely arrested him without legal justification. Plaintiff was taken into custody and wrongfully held for over 24 hours. Plaintiff was also maliciously prosecuted, requiring him to return to court multiple times over an extended period until all charges were ultimately terminated. Plaintiff sustained physical and emotional pain and injuries as a result of this incident.
