Summary

[redacted] stated that at approximately 9 a.m. on June 7, 2004, his sister, [redacted] called 911 because their schizophrenic uncle, [redacted] had hit [redacted] Officers identified by investigation as Officer Darryl Chen and Officer Albert Cotson arrived and determined, against [redacted] wishes, that [redacted] would not be removed from the apartment. During an argument between [redacted] and the officers, Officer Chen allegedly used profanities (allegation A). [redacted] also alleged that Officer Chen, in response to [redacted] ordering the officers to leave and threatening to call a supervisor, grabbed [redacted] by the throat, choked him, pushed him against a wall, and repeatedly banged his head against the wall (allegations B and C). [redacted] pulled Officer Chen off her brother, and in response Officer Chen grabbed [redacted] by the hair and repeatedly banged her head against the metal frame of her bed (allegation D). Officer Cotson restrained [redacted] from moving towards Officer Chen by grabbing onto him and pulling him to the floor (allegation E). Both [redacted] and [redacted] were handcuffed. Numerous EMTs and backup officers, supervised by Sergeant David Cheesewright, responded to the location. [redacted] alleged that officers then searched his apartment (allegations F).
