On November 12, 2006, at approximately 11:30 PM, [redacted] was walking down East 117th Street near the corner of 5th Avenue in Manhattan with his friend [redacted]. Two marked police cars and an unmarked Chevrolet pulled up to them and [redacted] immediately ran away while PO Miroslav Maric and PO Adnan Radoncic arrested [redacted]. PO Peter Bolte chased after [redacted] on foot as he headed east on 117th Street. As [redacted] approached Madison Avenue, a marked patrol car cut him off and Lieutenant Christopher Schmidt exited the vehicle and chased after [redacted]. Lieutenant Schmidt tackled [redacted] from his left side and brought him to the ground (allegation A). While [redacted] was on the ground, he was punched and kicked in the face and body by Lieutenant Schmidt and PO Wilfred Garcia (again allegation A and allegation B). While [redacted] was being handcuffed, a plainclothes officer said, "Yeah we got your ass. Fuck you, you little bastard. Stupid" (allegation C).
