Summary

On January 17, 2007, around 6:00 p.m., [redacted] was standing inside [redacted] located on the corner of [redacted] and [redacted] in Brooklyn. PO Timothy Schultz and PO Justin Caballero from the 73rd Precinct entered the store and stopped [redacted] (Allegation A, B). PO Schultz searched [redacted]'s pockets (Allegation C). The officers told [redacted] to leave the store, and then they left the store. [redacted] left the store shortly thereafter and PO Schultz ran across the street and pulled on [redacted]'s jacket, telling him to the get on the ground and saying, "Shut the fuck up. You're being an asshole" (Allegation D). PO Schultz struck [redacted] about the body with his asp (Allegation E). [redacted]'s sister, was nearby and saw the altercation. She attempted to approach her brother and PO Caballero pushed her backward and said, "Get the fuck back," (Allegation F). The officers called for additional units and [redacted] called family members. [redacted] was taking officer's names, when an unknown officer punched her in the face (Allegation G). She was handcuffed by PO John Rosa and PO John Siraco from PSA 3. PO Rosa called her a "little black bitch," and when she expressed concern for her cousin told her, "Fuck your baby. We're calling ACS," (Allegation H, I, J, K). [redacted] was brought back to PSA 3 and placed under arrest. An unidentified officer swung an asp at [redacted]'s brother, but did not strike him (Allegation L). An unidentified officer pushed [redacted]'s mother (Allegation M).
