Summary

On March 10, 2007, at approximately 8:00 PM, [redacted] exited her apartment building at [redacted] in the Bronx. She had been there for approximately two hours. [redacted] apartment building, which is part of a housing project, contains a walkway leading residents from the front doors of their buildings to the sidewalk of East 179th Street. [redacted] began her way down this walkway when she saw a man she knows named [redacted] is not homeless, but often asks others for money. [redacted] had seen him around the neighborhood before and was friendly with him. [redacted] approached [redacted] and asked her if she could spare any money. As the two walked onto East 179th Street from the walkway, [redacted] took some change from her pocket and handed it to [redacted] The two were also talking as they walked. Almost immediately after reaching East 179th Street, PO Dominguez (whom [redacted] identified by name, and described as a male in his late 40's, about 5'7", with a medium build) approached [redacted] and told her to stop (Allegation A). At this point [redacted] was on the sidewalk of East 179th Street. She also noticed that a second officer, PO Frias, was standing near PO Dominguez, and a police car containing an officer in the front seat was parked next to the sidewalk. [redacted] identified PO Frias by name, stating that his nametag read "Fraud" or something of the sort. She stated that he was a Hispanic male in his 20s, 5'6".) There was also a large black man sitting in the back of the police car.
PO Dominguez asked [redacted] what [redacted] had given her. [redacted] replied that she had given him some change. PO Dominguez then told [redacted] to open up his hand. [redacted] did this, revealing the change to which he still clung. PO Dominguez grabbed the change, then placed it in [redacted]'s pocket. PO Dominguez asked [redacted] what she was doing there, and if she was buying drugs.
