On March 17, 2007, at approximately 10:43 PM, [redacted] walked by a red Toyota Land Cruiser that was parked with its keys in the ignition on [redacted] and [redacted] stole the vehicle and placed his [redacted] daughter into the back car seat. Several minutes later, the owner of the car, [redacted], noticed his car was stolen and called the police. He reported that his car was stolen and told the police the make, model, and license plate of his car. Lt. Joseph Lyons, Lt. Philip Rivera, and PO Marcos Sanchez, who were assigned to a conditions team that was on patrol at [redacted] heard the description over the radio and observed [redacted] stopped at that intersection facing westbound on [redacted] Lt. Lyons stopped his vehicle behind the Toyota Land Cruiser and Lt. Lyons and PO Sanchez exited the vehicle. [redacted] alleged that Lt. Lyons drove his vehicle into the back of the Land Cruiser, which caused it to crash into a parked vehicle (Allegation A). PO Sanchez identified himself as a police officer and told [redacted] to stop. [redacted] veered to the left, crossed the double yellow line, took a left through the red-light, and drove northbound on [redacted] Lt. Rivera and PO Sanchez got back into their vehicle and Lt. Lyons pursued [redacted] PO Sanchez predicted that [redacted] was driving away from the officers at approximately 50 to 60 MPH. Because it had snowed recently, the Land Cruiser was fishtailing across the double yellow line into the southbound lane. When [redacted] got to the intersection of [redacted] he lost control of the Toyota Land Cruiser and crashed into the cars on the southwest corner of the intersection, which resulted in a five car pile up. [redacted] exited his vehicle and ran to the back of his car and reached into the vehicle. As he did this, Lt. Lyons drove towards the intersection and PO Sanchez exited the vehicle.
