On November 3, 2007, at approximately 10:00 p.m., [redacted] and his teenaged sons [redacted] and [redacted] along with [redacted]s brother [redacted] and his teenaged sons Mota [redacted] went to dinner at the Eastern Nights restaurant, located at 25-37 Steinway Street in Queens. On November 4, 2007, at approximately 12:30 a.m., [redacted] and [redacted] were outside the restaurant, allegedly throwing a cellular phone between them, when Lieutenant Joseph Gulotta, who was with Sergeant Joseph Corideo, Officer Lisamarie Velotta, and PO Vincent Florez, approached [redacted]. [redacted] tried to walk away, and Lt. Gulotta grabbed his wrist and threw him to the floor as [redacted] tried to get away, and handcuffed him (allegation A). As Lt. Gulotta was handcuffing [redacted], [redacted] attempted to push Lt. Gulotta off of [redacted], and Lt. Gulotta allegedly pushed him (allegation B). PO Velotta allegedly threatened to arrest [redacted] when he protested [redacted]s arrest (allegation C). PO Velotta also allegedly told [redacted] who was using crutches at the time of the incident, to move his "crippled ass" (allegation D). Some of the other boys informed [redacted] and [redacted] and they exited the restaurant. [redacted] was arrested for [redacted]. Sgt. Corideo allegedly threatened to "snap [his] hand" as he handcuffed him (allegation E). An unidentified Hispanic officer allegedly threatened to arrest [redacted] and [redacted] (allegation F). Throughout the incident, Lt. Gulotta, Sgt. Corideo, PO Velotta, and PO Florez allegedly used profanity while speaking with the group, specifically the word "fuck" (allegations G, H, I, and J). While speaking with [redacted] and [redacted] at the 114th Precinct stationhouse, Officer Serge Jean-Baptiste allegedly told [redacted] and [redacted] to "sit [their] asses down" (allegation K).
