On November 19, 2014, at approximately 8:45 p.m., in the vicinity of [redacted] Manhattan, [redacted] was walking to his vehicle. A marked police vehicle occupied by LT Javad Valad and PO Janielle Mendoza from the 32nd Precinct drove by and LT Valad allegedly said, "You ugly mutt. African dog-man. You're gonna [sic] be stopped," to [redacted] from inside the police vehicle (Allegation A). [redacted] ignored what LT Valad said and kept walking. LT Valad and PO Mendoza exited their vehicle and approached [redacted] LT Valad then allegedly said, "African dog-man. You ugly," to [redacted] (Allegation A). An argument between [redacted] and LT Valad ensued. LT Valad and PO Mendoza eventually returned to their vehicle and left the scene. [redacted] was not arrested or issued a summons. [redacted]
[redacted] ignored LT Valad's comment, but LT Valad and PO Mendoza exited their police vehicle and approached him. LT Valad then allegedly said, "African dog-man. You ugly," to [redacted] argued with LT Valad about how officers should treat people (encl. 7a-7c). The officers returned to their vehicle, and no police action was taken.
LT Valad stated that he had seen [redacted] looking into car windows in a location where there had been car break-ins. Lt. Valad wanted to approach [redacted] because of this observation. LT Valad stated that he asked [redacted] if the vehicle that he was looking into belonged to him, but [redacted] refused to answer and screamed that the officer approached him because he was black and accused LT Valad of harassing him and stopping him. LT Valad told [redacted] that he was free to leave, and eventually LT Valad and PO Mendoza returned to their vehicle and left. LT Valad denied saying, "You ugly mutt. African dog-man. You're gonna [sic] be stopped," to [redacted]. LT Valad also denied saying, "African dog-man. You ugly," to [redacted] (encl. 8a-8f). PO Mendoza, who characterized the interaction with [redacted] similarly to LT Valad, denied hearing LT Valad say either remark (encl. 9a-9f).
