Summary

On August 13, 2016, at approximately 3:00 a.m., PO Katherine Lopez and PO Luis Cabrera of the 40th Precinct pursued a civilian vehicle occupied by [redacted] to a gas station at Tiffany Street and Garrison Avenue in the Bronx. PO Lopez and PO Cabrera called for backup over the radio, and they stopped the civilians' car inside of the gas station with the assistance of other unidentified officers. All of the officers allegedly exited their vehicles and approached the civilians' car with their guns drawn and pointed at the car (Allegations A, B, and C). Numerous additional officers in uniform and in plainclothes from many different commands, including the 41st Precinct; 40th Precinct; and Highway Patrol 1, arrived on the scene. Among the officers who responded to the incident were Sgt. William Miller, PO Stephen Barry, and PO Brian DeStefano of the 40th Precinct and PO Mandeep Singh, PO Gabrielle Rodriguez, PO Kenny Maldonado, PO Shamere Boland, PO Jillian Snider, and Lieutenant Raymond Meyer of the 41st Precinct.

[redacted] ran across the street from the gas station upon seeing the officers approach the vehicle with their guns drawn. PO Rodriguez, PO Maldonado, and PO Singh pursued [redacted] and additional unidentified police officers joined in the pursuit (Allegations D, E, and F). An unidentified officer allegedly said, "What the fuck is your problem" while pursuing [redacted] (Allegation G). PO Singh drew his gun, pointed it at [redacted] and said, "Freeze. Put your hands up" (Allegation H). PO Singh then struck the upper left part of [redacted]'s forehead with his gun (Allegation I), and an unidentified officer struck the right side of [redacted]'s cheek with his gun (Allegation J).
