On March 12, 2017, [redacted] and [redacted] hosted friends including [redacted] and [redacted] at their home at [redacted], in Queens, to watch the annual Phagwah Parade. At approximately 9:30 am, before the guests arrived, Sgt. Christopher Winiarz of 102nd Precinct, allegedly drove by the house and "shook" his handcuffs at [redacted] (Allegation A). At approximately 12:30 pm, DI Deodat Urprasad, Commanding Officer of the 102nd Precinct, saw [redacted] drinking from a cup on the house's gated front steps, and, along with Lt. Christopher Estrella of the 102nd Precinct, approached the property. DI Urprasad requested identification, allegedly told [redacted] to, "Get the fuck over here," (Allegation B) and then reached over the gate to open the latch. [redacted] retreated into the house. DI Urprasad entered the property, pulled [redacted] from within the house, and placed him under arrest (Allegations C and D). [redacted] emerged from the front door and asked what was happening. DI Urprasad placed [redacted] under arrest (Allegation E) and allegedly told him, "You guys are not supposed to be fucking drinking in front" (Allegation F). DI Urprasad asked [redacted] why his hands were in his pockets (Allegation G) and allegedly frisked [redacted] (Allegation H). [redacted] asked Sgt. Kevin Bischoff for his name, and Sgt. Bischoff allegedly said, "John Doe" (Allegation I). [redacted] and [redacted] were charged with [redacted] DI Urprasad allegedly refused to provide his name to [redacted] (Allegation J).
Approximately 10 minutes later, Sgt. Joseph Demarco, PO Tommy Choi, Det. Alex Cruz, and PO Scott Adelman, all of the 102nd Precinct, approached the house after Sgt. Demarco observed [redacted] drinking within the gated area. Sgt.
