On April 3, 2017, at approximately 6:07 p.m., [redacted] who was driving a [redacted] delivery truck, was on Cruger Avenue, between Lydig Avenue and Pelham Parkway South in the Bronx, when he noticed two marked police vehicles parked side by side blocking traffic. [redacted] approached the vehicles and asked Sergeant Tameika Goode and Police Officer Andrew Kellard of the 49th Precinct what was going on. Both Sergeant Goode and Police Officer Kellard allegedly told him to "Get the fuck out of here" (allegations A and B). Sergeant Goode allegedly told him that she could get in contact with his supervisor and issue him a summons (allegation C). After [redacted] returned to his vehicle, Police Officer Kellard approached him and asked him for his driver's license and his supervisor's name and phone number. [redacted] refused and attempted to close the door to end the conversation. Police Officer Kellard allegedly caught the door, grabbed [redacted] by the back of his neck and climbed into the truck. Police Officer Kellard "wrestled" him onto the floor of the truck and allegedly punched him approximately three or four times on the right side of his face.
