Summary

On the morning of April 27, 2017, [redacted] and [redacted] got into a fight at the corner of East 211th Street and White Plains Road in the Bronx. Afterwards, [redacted] filed a complaint against [redacted] with PO Jesus Ramos and PO Lennin Badia of the 47th Precinct. At 5:52 p.m., [redacted] called 911 to report that [redacted] was sitting in front of MetroPCS at 3530 White Plains Road in the Bronx. PO Ramos and PO Badia again responded, with backing from PO Rafael Rispoli and PO Cody Petrucci of the 47nd Precinct. [redacted] positively identified [redacted] and PO Ramos informed [redacted] that he was under arrest. [redacted] refused to comply and a struggle ensued. Shortly thereafter, PO Matthew DiSilvestre and PO Jared Faber of the 47th Precinct also arrived. The officers subsequently used force on [redacted] to try to get him into handcuffs (Allegations A, B, C, D, E and F). PO Ramos also Tased [redacted] at least two times (Allegation G).
After [redacted] was handcuffed, he was placed in a van. [redacted] owner of MetroPCS, who had been videotaping the incident, ran towards the van to continue taping. PO Rispoli told [redacted] to, "Get the fuck out the way," (Allegation H) and pushed [redacted] back with his arm (Allegation I). [redacted] then began heckling the officers, calling them rookies.
