On June 5, 2018, at 6:44 p.m., [redacted] were pulled over by PO Vincent Gambino and PO Sean Collins, of the 75th Precinct, in the vicinity of Highland Boulevard and Jamaica Avenue in Queens due to a broken rear taillight.
After [redacted] provided PO Gambino with her driver's license, he asked her to step out of the vehicle. She complied. [redacted] exited the vehicle with a cellphone in her right hand. PO Gambino asked her to put it away and she did not comply. PO Gambino pushed [redacted] into the driver's door and handcuffed her (Allegation A: Force, [redacted]). As a result, the cellphone fell to the ground and the video stopped (Allegation B: Abuse of Authority, [redacted]). After [redacted] was handcuffed, PO Gambino frisked (Allegation C: Abuse of Authority, [redacted]) and searched her (Allegation D: Abuse of Authority, [redacted]).
Simultaneously, PO Collins asked [redacted] to exit the car and he complied. PO Collins questioned [redacted] (Allegation E: Abuse of Authority, [redacted]), searched him (Allegation F: Abuse of Authority, [redacted]), and frisked him (Allegation G: Abuse of Authority, [redacted]).
Later, PO Collins searched [redacted]'s vehicle, including the trunk (Allegation H, Abuse of Authority, [redacted]).
As a result of this incident, [redacted] were not arrested, but [redacted] was issued a summons for inadequate or no stop lamp (BR 03).
