Summary

On April 14, 2019, at approximately 10:45 p.m., PO Brendan Thompson and PO Herbert Davis of the 46th Precinct responded to a 911 call regarding harassment at [redacted] in the Bronx. PO Thompson and PO Davis subsequently approached [redacted]'s apartment on the fourth floor. As PO Davis knocked on the door, the door opened by itself. PO Davis stepped inside the apartment and extended his asp (Allegation A: Abuse of Authority, [redacted]; Allegation B: Abuse of Authority, [redacted]). As PO Thompson held the taser in his left hand, he drew his firearm with his right hand and pointed both at [redacted] (Allegation C: Force, [redacted]). PO Thompson subsequently tasered [redacted] (Allegation D: Force, [redacted]). PO Davis and PO Thompson then entered [redacted]'s residence in order to handcuff him (Allegation E and F: Abuse of Authority, [redacted]). PO Davis and PO Thompson then backed out of the residence before PO Thompson fatally shot [redacted] four times (Allegation G: Force, [redacted]). PO Thompson and PO Davis failed to render medical aid to [redacted] after he was shot (Allegations H and I: Abuse of Authority, [redacted]).
The Bronx District Attorney's Office declined to charge PO Thompson and PO Davis and the NYPD Force Investigation Division (FID) cleared them of misconduct (Board Review 01 and 02). Read report for details.
