Summary

On July 31, 2019, at approximately 10:25 p.m., [redacted] left Gourmet Deli, located at Pitkin Avenue and Miller Avenue in Brooklyn. He encountered his friends [redacted] and a third individual, and they stood in front of the deli. Approximately five minutes later, PO John Plumitallo, PO [redacted] and PO [redacted] of the 75th Precinct, arrived in an unmarked vehicle. PO Plumitallo and PO [redacted] exited the vehicle and stopped Mr. [redacted] (Allegations A-B: Abuse of Authority, substantiated). PO [redacted] strip-searched Mr. [redacted] (Allegation C: Abuse of Authority, substantiated). PO Plumitallo allegedly also searched Mr. [redacted] (Allegation D: Abuse of Authority, unsubstantiated). PO [redacted] punched Mr. [redacted] cheek (Allegation E: Force, exonerated). All three officers took Mr. [redacted] down to the ground (Allegations F-H: Force, exonerated). A struggle then ensued, in which PO [redacted] and PO [redacted] punched Mr. [redacted] (Allegation I: Force, substantiated; Allegation J: Force, exonerated). PO [redacted] then allegedly placed Mr. [redacted] in a chokehold, which allegedly restricted his breathing (Allegations K and L: Force, unsubstantiated). Officers then handcuffed Mr. [redacted] and PO [redacted] stated, "Get him the fuck up" (Allegation M: Discourtesy, substantiated). After officers lifted Mr. [redacted] into an upright position, PO [redacted] allegedly punched Mr. [redacted] (Allegation N: Force, unsubstantiated). While Mr. [redacted] recorded the interaction, PO [redacted] of the 75th Precinct, shone his flashlight at Mr. [redacted] cell phone (Allegation O: Abuse of Authority, unsubstantiated). Additionally, officers allegedly told individuals, "Get the fuck out of here" (Allegation P: Discourtesy, officer(s) unidentified).
