Summary

On July 31, 2019, at approximately 11:10 a.m., [redacted] was inside her room on [redacted] in Brooklyn when she heard knocking on her apartment door. She opened the door and spoke to PO Jose Ramirez, who was accompanied by PO Rodney Souffrant, both of the 72nd Precinct. PO Ramirez told [redacted] that he needed to speak to her about a complaint filed by her neighbor, [redacted]. [redacted] had informed the officers that [redacted] had been smoking into his window, which aggravated his asthma. [redacted] who speaks mostly Spanish, asked the officers for a Spanish speaking officer, and PO Ramirez allegedly told her that there were no Spanish-speaking officers available (Allegation A: Abuse of Authority, [redacted]).
[redacted] called for her stepmother, [redacted]. PO Ramirez, PO Souffrant, [redacted] and [redacted] went to the second-floor balcony where [redacted] smokes. PO Ramirez told [redacted] in Spanish, that [redacted] was not permitted to smoke on the balcony or on the premises. PO Ramirez allegedly told [redacted] that if he saw her on the street, he would arrest her (Allegation B: Abuse of Authority, [redacted]). [redacted] asked PO Ramirez to confirm whether [redacted] was prohibited from smoking inside the house, and PO Ramirez told [redacted] that she was prohibited from smoking too.
