At approximately 12:30 a.m., on November 5th, 2020, [redacted] was in front of the Diddle Dee Bagel & Deli located at 1334 Richmond Road in Staten Island with [redacted] when an individual whose name the investigation only obtained as [redacted] and [redacted] when an unmarked sedan pulled into the deli's parking lot, and allegedly made noise on the car's intercom system. [redacted] approached the unmarked car and verbally addressed its occupants: Police Officer Vincent Mandracchia and Police Officer Jacob Samuel of the 122nd Precinct.
Shortly thereafter, Police Officer Mandracchia and Police Officer Samuel approached [redacted] as he sat on a picnic table at the side of the deli speaking to [redacted] and [redacted]. Police Officer Mandracchia and Police Officer Samuel asked [redacted] for his ID. When [redacted] did not provide his ID after repeated requests, Police Officer Mandracchia called for back-up and told him, "Give me your fucking ID" (Allegation A – Discourtesy (Word): [redacted]). As Police Officer Mandracchia continued to ask [redacted] for his ID, he tried to grab [redacted] arm. Several officers from the 122nd Precinct then arrived on scene and approached [redacted]. As Police Officer Mandracchia and the officers tried to handcuff [redacted], Police Officer Mandracchia told [redacted] "Get the fuck down" and "Put your fucking hands behind your back" (within Allegation A). Officers then physically interacted with [redacted] as they tried to handcuff him on the picnic table. Police Officer Mandracchia and Police Officer Samuel punched [redacted] on the side of his face and then allegedly kicked him in the legs and kneed him in the stomach and chest (Allegation B – Physical Force, [redacted] (Allegation C – Physical Force, [redacted]).
