Summary

On November 11, 2020, at approximately 12:07 a.m., Lieutenant Jose Garcia and Police Officers Romeo Poliard and Cynthia Lopez of the 41st Precinct stopped [redacted] for running a red light at the intersection of Hunts Point Avenue and Garrison Avenue in the Bronx. PO Poliard allegedly told [redacted] to "get the fuck out" of his car (Allegation A: Discourtesy, [redacted]). [redacted] refused to provide ID for the officers to issue him a summons, so Lt. Garcia placed [redacted] under arrest for aggravated unlicensed operation of a motor vehicle, unlawful possession of marijuana, driving without a license, and running a red light (Board Review 01). Once [redacted] was out of the car, PO Poliard allegedly squeezed [redacted] genitals while frisking him (Allegation B: Force, [redacted]). When [redacted] asked PO Poliard, "You want to touch my dick, man?" PO Poliard responded, "Damn right" (Allegation C: Discourtesy, [redacted]). PO Poliard allegedly told [redacted] to "shut the fuck up" (Allegation D: Discourtesy, [redacted]). PO Poliard escorted [redacted] to a police vehicle and told Police Officers Joel Feliz and Abel Dupres of the 41st Precinct regarding [redacted] "He's a dumbass, search him" (Allegation E: Discourtesy, [redacted]). Lt. Garcia had [redacted] vehicle brought back to the stationhouse (Allegation F: Abuse of Authority, [redacted]).
Once at the 41st Precinct stationhouse, PO Poliard allegedly squeezed [redacted] between his legs while in the cells at the stationhouse (Allegation G: Force, [redacted]).
