On October 13, 2022, at approximately 7:16 PM, [redacted] and his brother, [redacted] encountered police activity at the intersection of West Kingsbridge Road and Bailey Avenue in the Bronx. Police officers stood at the center of the intersection and directed traffic. [redacted] attempted to turn left onto West Kingsbridge Road before Police Officer Ariel Eusebio from the 52nd Precinct stepped in front of their black Chevrolet SUV and instructed them to make a U-turn. [redacted] lifted his upper torso outside the front passenger window and tried to explain that flow of traffic prevented the maneuver. Police Officer Rolando Deleon from the 52nd Precinct shouted at [redacted] and began walking towards him. PO Deleon drew his firearm from his holster after opening the front passenger door and pointed it at [redacted] (Allegation A: Abuse of Authority – Gun Drawn, [redacted]). PO Deleon returned his firearm to its holster and engaged in a verbal dispute with [redacted]. [redacted] told PO Deleon to shut up. PO Deleon replied, "Get out the car and make me shut the fuck up."
