Description: On October 21, 2018, plaintiff was unlawfully arrested by NYPD officers Ricardo Montilla, Kirk Bishop, Matthew Ferguson, and Juan Collado. Despite complying with the officers' orders, Montilla and Bishop grabbed plaintiff by his arms, forcibly pulled him onto the concrete, and placed overly tight handcuffs on his wrist. Montilla then forcefully lifted plaintiff's handcuffed arms behind his back. Plaintiff informed the officers that they were hurting him, yet Montilla continued to keep his arms raised. The officers transported plaintiff to an NYPD precinct and eventually to the Manhattan Detention Complex. Description: On or about May 11, 2017, Officers Robert Giery, Sergeant Ricardo Montilla, and other officers detained and arrested the plaintiff on charges of weapon possession for an alleged pipe found in his car. However, the plaintiff had no pipe intended or designed as a weapon. The officers willfully and unlawfully arrested, detained, imprisoned, and searched the plaintiff, seizing his property, which was never returned. The defendants proceeded with the arrest based on accusations they knew or should have known were false, and knowingly provided false information to the prosecutor in the ensuing criminal case against the plaintiff.
