Despite being the alleged victims, they were arrested by Officer Jeffrey Peloso of the 79th Precinct on charges including assault and menacing. The complaint asserts that video footage showed they did not engage in criminal activity, and the arrests were made without probable cause. Description: On June 22, 2022, P.O. approached Plaintiff’s vehicle while Plaintiff was lawfully present in the vicinity of Lafayette Avenue, County of Kings. P.O. noted to her that her car was in repossession. Then, Plaintiff explained that her bill was due but not yet past due. Nonetheless, P.O. began shouting at the Plaintiff to get out of her vehicle, flashing their blue lights and shining flashlights in the Plaintiff’s face. The Plaintiff asked not to do it, saying she has been diagnosed epileptic since 2011.
