Description: On or about November 28, 2018 Plaintiff suffered gunshot wounds to his neck and chest on the streets of Queens. EMS operators brought Plaintiff to Elmhurst hospital and underwent surgery. While recovering from his injuries and surgery, NYPD officers without any probable cause or charges against Plaintiff detained him with handcuffs and held him against his will from November 29, 2018 to December 11, 2018. NYPD Officers implemented its "Hospitalized Prisoner" policy against Plaintiff requiring his family to submit "Hospitalized Prisoner" forms to be approved in order to visit Plaintiff, and detaining him despite lack of charges in order to obtain information from Plaintiff.
