Description: On or about November 15, 2019, Plaintiff was lawfully in Manhattan when he was unlawfully stopped and frisked by the defendants BRANDON GEMBECKI, JORGE MONGE and other unknown police officers. After the stop, plaintiff was arrested, handcuffed and transported to an NYPD Precinct where he was processed and remained for approximately 1 day. He was then taken to the Manhattan Detention Center where he remained for several weeks. On May 6, 2021, the DA made a Recommendation of Dismissal for both the indictment and prosecution of the plaintiff due to, among other things, the credibility of the individual named police officer defendant.
