Conclusion Meanings:

'Exonerated': or 'Within NYPD Guidelines' - The conduct occurred but did not violate the NYPD's own rules, which often give officers significant discretion.
'Substantiated': The misconduct occurred and it violated the rules. The NYPD has discretion over what, if any, discipline is imposed.
'Unfounded': Evidence suggests that the event or alleged conduct did not occur.
'Unsubstantiated': or 'Unable to Determine' - The alleged conduct was investigated but could not determine both that the conduct occurred and that it broke the rules.
'Within NYPD Guidelines': The conduct occurred but did not violate the NYPD's own rules, which often give officers significant discretion.

Complaint
Description: On November 27, 2023, the plaintiff was lawfully seated in the driver's seat of his car, which was lawfully parked by the curb, conversing with some friends. Defendant NYPD officers parked alongside his vehicle and asked him "what are you doing?" The plaintiff responded with "what do you mean?" After a couple more harmless words were exchanged the defendants exited their vehicle, approached the plaintiff and instructed him to exit his vehicle because they wanted to search him. The plaintiff obeyed their commands but was still confused by their actions. Nothing illegal was recovered from the person of the plaintiff. Following the unlawful search, the defendants reentered their vehicle and left the scene.
