On September 16, 2008, at approximately 10:00 PM, [redacted] was walking on Adam Clayton Powell Jr. Boulevard near West 127th Street in Manhattan. He had attended the African-American Day Parade earlier that day with his nephew, [redacted] and two of [redacted] companions, [redacted] and [redacted] A crowd formed behind [redacted] An officer, whom the investigation was unable to identify, pushed [redacted] on his back (Allegation A). A second officer, whom the investigation was unable to identify, then pepper sprayed [redacted] on his chin and mouth (Allegation B). When [redacted] recovered from the effects of the pepper spray, he looked for the officers in order to obtain their names and shield numbers. [redacted] accompanied him.
When they were unable to find them, [redacted] and [redacted] began walking towards the subway station, located at West 125th Street and 7th Avenue in Manhattan. They walked past a group of officers, identified through the investigation as Sgt. Christopher Siani, PO Daniel Ehrenreich, PO Richard Pengel, PO William Butler and PO Aaron Thorn from the 32nd Precinct. [redacted] shouted, "Fuck the police!" as he passed by them. [redacted] was then punched repeatedly and brought to the ground, where he felt himself kicked (Allegation C, D and E). [redacted]'s lower lip was bleeding. An ambulance responded to the scene and he was transported to [redacted] Hospital. [redacted] began to record the incident with the camera on his cellular telephone. He alleged that Sgt. Siani hit the cellular telephone out of his hand (Allegation F) and pulled him to the ground by holding his arms behind his back (Allegation G). As a result of being pulled to the ground, [redacted] injured his left ankle.
[redacted] was handcuffed and transported to the 28th Precinct, where he was issued a summons for disorderly conduct.
