Summary

On June 12, 2014, at approximately 12:39 a.m., [redacted] and four friends left a house on [redacted] in Brooklyn and were walking to a store on Shepherd Avenue and Pitkin Avenue. [redacted] saw a "black Impala" approaching while he stood at the corner of [redacted]. The individual driving the car was Sgt. Robert Martinez. Sgt. Martinez stopped his vehicle and got out of the vehicle, at which point [redacted] and his friends scattered and ran in different directions. Sgt. Martinez chased [redacted] who ran to the front door of a house located at [redacted] and rang the doorbell. While ringing the doorbell, he turned around and saw Sgt. Martinez with his gun pointed at him (Allegation A and B). [redacted] turned back around to face the door and allegedly heard Sgt. Martinez fire a shot (Allegation C). Sgt. Martinez allegedly told [redacted] "Don't move or I'll shoot you. I've been waiting to shoot you." [redacted] also alleged that Sgt. Martinez said, "Put the phone down. Don't you fucking move. I swear I've been fiending to shoot you. I'll shoot." (Allegation D and E) [redacted] then lay down on his back with his hands out to the side and his phone in his right hand. Sgt.
