On December 23, 2015, at approximately 1:45 a.m., [redacted], [redacted], [redacted] and [redacted] were returning from Starlett's Strip Club in Queens. While the three individuals were inside of a cab outside of [redacted] in Brooklyn, an unmarked Chevy Impala pulled up behind the cab. As all three of the individuals exited the cab, they were approached by PO Peter Lazare, PO Frederick Manney and Sgt. [redacted] Rodenas of the Strategic Response Group (Allegation A). [redacted] and [redacted] both alleged that PO Manney and Sgt. Rodenas frisked and searched [redacted] (Allegations B, C, D and E) PO Lazare approached [redacted] and allegedly stated, "Put the fucking phone away" (Allegation F) and attempted to grab his arm. PO Lazare then allegedly stated, "Get the hell off the phone" and proceeded to grab [redacted] by his jacket and wrestled him to the ground. PO Lazare landed on top of [redacted] and stated, "Gun." PO Lazare attempted to place [redacted] hands behind his back and [redacted] pulled his arms forward. PO Lazare allegedly punched [redacted] one to two times on the right hand-side of his face near his eye and nose. PO Manney and Sgt. Rodenas then approached [redacted] while he was on the ground and allegedly kicked him in the face approximately four to five times (Allegation G). While on the ground, Sgt. Rodenas pepper sprayed [redacted] in his face for approximately five to ten seconds (Allegation H). [redacted] also alleged that she was pepper sprayed by Sgt. Rodenas and she used her hair to block the mace (Allegation I). [redacted] alleged that she attempted to record the incident with two of her cell phones, PO Lazare grabbed each phone out of her hand and allegedly threw both phones behind her. She alleged that the screen on one of her phones was cracked (Allegations J and K).
