Summary

[redacted] and the vehicles' other occupants fled from the vehicle and scattered. Sgt. Daverin, PO Walsh, and PO Cuoco pursued [redacted] Southbound on Sheffield Avenue. PO Cuoco stopped [redacted] (Allegation D) and took [redacted] to the ground (Allegation E). The Anti-Crime officers requested assistance, and numerous other uniformed and plainclothes units responded to the scene. PO Michael Kaminsky and PO Giovanni Fini of the 75th Precinct secured the abandoned SUV. Meanwhile, PO Cuoco and Sgt. Daverin used physical force against [redacted] while subduing him and placing him in handcuffs (Allegations F and G). After [redacted] was placed in handcuffs, an officer allegedly struck him multiple times in the face and back (Allegation H). During the struggle, an officer allegedly said, "Take out the gun. Where is the gun at?" (Allegation I). An officer then allegedly dragged [redacted] several feet across the sidewalk (Allegation J). [redacted] was then placed in the rear of an RMP. PO Walsh allegedly asked, “Where's the fucking gun, asshole?" (Allegations K and L) and then said to [redacted] "Cut the crap, asshole" (also Allegation L).
PO Frank Ingrao and PO Donald Perceval of the 75th Precinct, who had responded during the incident, transported [redacted] to the 75th Precinct stationhouse. En route, [redacted] told the officers that he did not feel well and needed to visit a hospital. An officer allegedly responded, “Shut the fuck up, asshole (Allegation M). Upon arrival at the stationhouse, [redacted] was lodged in a cell on the empty side of the cell area which was normally occupied by female prisoners. There, Sgt. Daverin and PO Walsh allegedly strip-searched him (Allegations N and O).
