On January 19, 2018, at approximately 8:58 AM, an ESU team entered [redacted] in Brooklyn in ordered to execute a search warrant obtained by PO Peter Chiofolo of the 67th Precinct (Allegation A: Abuse of Authority, [redacted]). The warrant was for the [redacted] apartment, where [redacted] resided with his parents, [redacted] and [redacted]. [redacted] was on the [redacted] landing, outside of the apartment, when the ESU officers entered. PO Dennis Mogelnicki of ESU allegedly pointed his handgun at [redacted], bringing the muzzle of the gun into contact with her temple (Allegation B: Force, [redacted]). Other members of the ESU team continued past [redacted] entering the [redacted] apartment (also Allegation A). Inside of [redacted]'s bedroom, Det. Daniel Keane of ESU allegedly struck [redacted] in the face with a ballistic shield (Allegation C: Force, [redacted]) and then, while [redacted] lay on the ground, allegedly placed a foot on [redacted]'s face (Allegation D: Force, [redacted]).
After ESU officers secured the apartment, DI Elliot Colon, Sgt. Charles Schwartz, PO Chiofolo, and PO Hector Casillas of the 67th Precinct entered the apartment (also Allegation A). [redacted] asked each of these officers to show him a copy of their search warrant, but they allegedly refused to do so (Allegation E: Abuse of Authority, [redacted]; Allegation F: Abuse of Authority, [redacted]; Allegation G: Abuse of Authority, [redacted]; Allegation H: Abuse of Authority, [redacted]). PO Casillas also allegedly refused to show a copy of the search warrant to [redacted] (Allegation I: Abuse of Authority, [redacted]). DI Colon also allegedly told [redacted] to "Shut the fuck up" (Allegation J: Discourtesy, [redacted]). The 67th Precinct officers then searched the apartment (Allegation K: Abuse of Authority, [redacted]).
