On May 31, 2018, at approximately 1:17 a.m., [redacted] s nephew, [redacted] was slashed in his face near her apartment building at [redacted] in the Bronx. [redacted] s friend, [redacted] called the police, and Lieutenant Eric Dym, Sergeant Natalie Bautista, and Police Officer Jody DeRoy of Police Service Area 7 (PSA 7), and numerous additional officers from PSA 7 and the 40th Precinct, responded to the scene. [redacted] and [redacted] attempted to walk away from police officers because [redacted] did not want any police contact. Lieutenant Dym told them to remain where they were, and they refused and continued to walk away. [redacted] was then handcuffed and placed under arrest for obstructing governmental administration and resisting arrest.
[redacted] s son, [redacted] who was [redacted] old at the time of the incident, told the officers to get off of [redacted] and he stepped directly in between her and the officers. He then began conversing with Lieutenant Dym, who allegedly spun him around, pushed him backwards against a gate, and slapped him in his face (Allegation A – Force: Physical Force, [redacted]). Police Officer Nashaly Malave of PSA 7 and three to four unidentified officers then allegedly brought [redacted] down to the ground and handcuffed him (Allegation B – Force: Physical Force, [redacted] Allegation C – Force: Physical Force, [redacted]).
[redacted] approached the officers and attempted to separate them from [redacted] by placing his arms between them. Police Officer DeRoy then allegedly pushed [redacted] down to the ground and handcuffed him (Allegation C – Force: Physical Force, [redacted]). An unidentified officer told [redacted] s friend, [redacted] to step away from [redacted] and she refused to comply. This officer then allegedly pushed [redacted] in her stomach (Allegation D – Force: Physical Force, alleged [redacted]).
