On April 16, 2020, at approximately 12:00am, [redacted] was walking on White Plains Road between Burke Avenue and Rosewood Street in the Bronx, when officers, identified via investigation as Lieutenant Joe Pulgarin, Police Officer Michael Gonzalez, Police Officer Michael Abbruzzese, and Police Officer Andrew Distelhurst, all of the 47th Precinct, and an unidentified officer, stopped him (Allegations A: Abuse of Authority, [redacted]). PO Gonzalez searched [redacted] backpack, frisked [redacted] and seized a knife that [redacted] said had been inside his backpack (Allegation B – D: Abuse of Authority, [redacted]). The officers left without providing [redacted] with RTKA business cards (Allegations E & F: Abuse of Authority, [redacted]). [redacted] began walking toward the 47th Precinct stationhouse.
Outside of 757 East 214th Street in the Bronx, [redacted] asked two different uniformed officers to call a supervisor to the location. Lieutenant Pulgarin, PO Gonzalez, PO Abbruzzese, PO Distelhurst, and the same unidentified officer arrived. PO Gonzalez questioned [redacted] and spoke discourteously to him (Allegation G: Abuse of Authority, [redacted]; Allegation H: Discourtesy, [redacted]) and PO Abbruzzese searched [redacted] backpack (Allegation I: Abuse of Authority, [redacted]).
