'Unable to Determine': The alleged conduct was investigated but could not determine both that the conduct occurred and that it broke the rules.
'Unfounded': Evidence suggests that the event or alleged conduct did not occur.
'Within NYPD Guidelines': The conduct occurred but did not violate the NYPD's own rules, which often give officers significant discretion.

Summary

At approximately 10:00 p.m. on December 6, 2022, [redacted] attempted to enter the 34th Street Penn Station A/C/E subway station in Manhattan without paying the fare. Police Officer Brendan Dono, of the 10th Precinct, prevented him from going through the emergency exit by pushing him back (Allegation A, Force, [redacted]). [redacted] continued to attempt to evade the fare, and PO Dono told [redacted] to "get the fuck back" (Allegation B, Discourtesy, [redacted]). PO Dono then asked [redacted] "do you wanna go to Bellevue?" (Allegation C, Abuse of Authority, [redacted], Allegation D, Offensive Language, [redacted]). PO Dono's partner on the incident date, Police Officer Tiana Hamilton, called for additional units. Several officers arrived and began to physically eject [redacted] from the transit system (Allegations E-F, Force, [redacted], Allegations G-H, Force, [redacted]). While officers attempted to restrain [redacted], PO Dono told [redacted] to "stop screaming like a maniac" (Allegation I, Offensive Language, [redacted]). It is alleged that PO Dono took law enforcement action on the basis of his housing status and disability (Allegations J-K Abuse of Authority, Bias-Based Policing, [redacted]).
