Summary

On January 14, 2016, at 6:40 p.m., PO Christian Diaz, Sgt. Yancy Blowe, PO Delilah Beniquez and PO Michael Deninno of the 73rd Precinct arrested [redacted] who was transported to the 73rd Precinct stationhouse by PO Beniquez and PO Deninno. Ten minutes earlier, Sgt. Eric Francis, Det. Hugo Ortega, Det. Jason Nino and Det. Gabriel Nacelewicz of Narcotics Borough Brooklyn North brought in five prisoners to the 73rd Precinct stationhouse. At the stationhouse, [redacted] was taken to the cell attendant's desk where he was searched and his belt was removed, allegedly causing [redacted]'s pants and underwear to fall to the floor. After [redacted] was searched, Sgt. Francis allegedly pushed [redacted] against the wall and told him, "If you move, you gonna hit the ground hard. We know about you, you wanna fight, you wanna fight? We know you're a tough guy" (Allegations A and B). [redacted] was placed in a cell by himself bare from the waist down and rear cuffed. [redacted] who was arrested earlier that day, was already in the cells at the time. Additionally, [redacted] and [redacted] who were brought in by the abovementioned officers from NARCBBN, were also lodged in the cells. At some point, [redacted] called to be moved from his cell as the toilet had flooded and Det. Nacelewicz and an unidentified plain clothes officer moved [redacted] to the cell with [redacted] and [redacted] During this transfer, one of the officers allegedly told [redacted] "I am gonna fuck you up" (Allegations C and D). [redacted] and [redacted] started complaining that they did not wish to be in the cell with [redacted] since he was undressed. As a result, PO Diaz went to the cells again.
