Summary

On September 27, 2020, at approximately 3:00 AM, Police Officer B [redacted], Police Officer Salvatore Rizzo, Police Officer B [redacted], Police Officer T [redacted] and Police Officer E [redacted] of the Criminal Intelligence Section and other Members of Service (MOS) from the same command and the 67th Precinct approached R [redacted] parked car, where he and his brother P [redacted] were asleep, outside [redacted] East 49th Street in Brooklyn. Since then, PO B [redacted], PO B [redacted], PO T [redacted] and PO L [redacted] have all been promoted to Detective. The MOS initially intended to do a wellness check on the two sleeping individuals, but after they woke up R [redacted] in the driver's seat and had him roll down his window, they smelled the odor of marijuana coming from inside the vehicle (Allegations A,B, C & D: Abuse of Authority –Stop, Exonerated). R [redacted] movements as he woke up caused PO B [redacted] and PO D [redacted] to believe he might be shifting into drive from park in order to flee. This caused PO B [redacted] to reach into the open window and hold R [redacted] against the seat while PO D [redacted] reached in to open the door to unlock it from inside. At approximately the same time, PO Rizzo approached the rear passenger door where P [redacted] was still asleep.
