Summary

On November 1, 2018, at approximately 11 p.m., Lieutenant Eric Dym and Police Officers Brian Greaige, Fray Severino-Jimenez, Manolin Molina, and Jose Tejada, all of whom were PSA 7 Anticrime officers at the time, saw [redacted] outside of his residence at [redacted] in the Bronx. They knew that [redacted] was the subject of a probable cause I-Card regarding a recent shooting in the area, and they attempted to arrest him. Several of [redacted] family members were present, [redacted] and were returning from a liquor store. These included his fiancée [redacted] his mother [redacted] his stepfather [redacted] his biological father [redacted] his cousin [redacted] and his friend [redacted] refused to be handcuffed and a struggle ensued. Dym and PO Severino-Jimenez both punched [redacted] at least once while they struggled with him standing up (Allegation C: Force, [redacted]; Allegation D: Force, [redacted]). [redacted] fell to the ground atop PO Molina, and Lt. Dym and PO Severino-Jimenez also went down to the ground while struggling with him. Lt. Dym punched [redacted] numerous times about the head and face (Allegation E: Force, [redacted]). At some point, an officer allegedly struck [redacted] with a blunt object (Allegation F: Force, [redacted]). Numerous officers responded to a radio request for emergency assistance, including Police Officer John Migliaccio of PSA 7.
