Summary

On April 18, 2018, at approximately 4:25 p.m., officers responded to East 219th Street and White Plains Road in the Bronx to disperse a large crowd of middle school-aged juveniles, some of whom were fighting each other. Officers told [redacted] to leave the area multiple times, and he refused to comply. Police Officer Donald Harris of the 47th Precinct attempted to arrest [redacted] but he ran away. Police Officer Harris chased [redacted] brought him to the ground, and handcuffed him (Allegation A – Force: Physical Force, [redacted]).
Numerous officers told the juveniles to leave the area or they would be arrested (Allegation B – Abuse of Authority: Threat of Arrest, [redacted]). The officers attempted to arrest [redacted] and an officer allegedly placed [redacted] in a chokehold by placing [redacted]s bead between his elbow and the side of his body (Allegations C and D – Force: Chokehold and Restricted Breathing, [redacted]). Sergeant Robert Durst of the 47th Precinct allegedly swung at [redacted] while he was in this chokehold and missed, and then Sergeant Durst brought [redacted] to the ground (Allegation E – Force: Physical Force, [redacted]).
